Privacy policy

Scope

This Privacy Policy applies to personal data processed by MokN in connection with the Services. It does not apply to personal data that MokN processes solely on behalf of a customer under a separate data processing agreement where that customer determines the purposes and means of the processing. In those cases, MokN acts as a processor or service provider and the customer’s own privacy notice governs its processing of personal data.

Personal data we collect

Depending on how you interact with the Services, we may process the following categories of personal data:

Account and contact information Name, business email address, employer, role, account identifiers and authentication-related information.
Technical and device information IP address, browser type, device information, operating system, timestamps, log data and information generated when connecting to the Services.
Usage information Information about how authorized users access and use the Services, including actions performed in the platform.
Support and communications data Information included in support requests, emails, meetings, feedback and other communications with MokN.
Customer-provided data Information submitted, uploaded, transmitted or otherwise made available by a customer or its authorized users through the Services.
Cookies and similar technologies Identifiers and technical information collected through cookies or comparable technologies where used.

MokN’s existing SaaS privacy documentation specifically identifies business email addresses and IP addresses as data that may be processed in connection with platform registration, login and technical protection measures.

Sources of personal data

We may collect personal data:

  • directly from you or your organization;
  • automatically when you access or use the Services;
  • from authorized users or administrators within your organization;
  • from service providers acting on our behalf; and
  • where permitted by law, from publicly available or professional sources.

How we use personal data

We may use personal data to:

  • provide, operate, maintain and secure the Services;
  • create and administer user accounts;
  • authenticate users and manage access to the Services;
  • provide customer support and respond to requests;
  • monitor performance, availability, integrity and security;
  • detect, investigate and prevent fraud, abuse, unauthorized access and security incidents;
  • improve the Services, including through aggregated or statistical analysis where appropriate;
  • communicate with customers and users about the Services;
  • comply with legal, regulatory and contractual obligations; and
  • establish, exercise or defend legal claims.

Legal bases for processing

Where the GDPR, UK GDPR or another law requiring a legal basis applies, MokN relies on one or more of the following:

  • Performance of a contract: where processing is necessary to provide the Services or administer a customer relationship.
  • Legitimate interests: including securing, operating, improving and protecting the Services and conducting ordinary B2B activities, where those interests are not overridden by your rights.
  • Legal obligations: where processing is required to comply with applicable law.
  • Consent: where consent is required by applicable law, including for certain cookies or communications.

How we disclose personal data

MokN may disclose personal data only where reasonably necessary for the purposes described in this Policy, including to:

  • hosting, cloud infrastructure, security, support and other service providers acting on our behalf;
  • professional advisers such as lawyers, auditors, insurers and accountants;
  • competent authorities, regulators, courts or law-enforcement bodies where required or permitted by law;
  • a purchaser, investor, successor or other relevant party in connection with a merger, financing, acquisition, reorganization or sale of all or part of our business, subject to appropriate safeguards; and
  • other parties where you or the relevant customer has instructed or authorized us to do so.

The MokN SaaS environment is hosted by Microsoft Azure in Europe according to MokN’s current contractual documentation.

International data transfers

MokN is established in France and primarily hosts its SaaS environment in Europe. If personal data is transferred outside the European Economic Area, the United Kingdom or another jurisdiction that restricts international transfers, MokN will use an appropriate transfer mechanism where required by law, such as an adequacy decision, standard contractual clauses, the UK International Data Transfer Addendum, or another legally recognized safeguard.

Data retention

We retain personal data only for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, comply with legal and contractual obligations, resolve disputes and enforce agreements.

MokN’s existing SaaS documentation provides that account-related data is retained for the duration of the subscription. It also provides for deletion of customer data following termination, including earlier deletion upon an express customer request, subject to the terms of the applicable contract and any legal retention requirements.

Security

MokN uses appropriate technical and organizational measures designed to protect personal data against unauthorized access, loss, alteration, disclosure or destruction. These measures may include encrypted communications, access controls, backups, monitoring, infrastructure redundancy and security procedures appropriate to the nature of the Services.

No method of transmission or storage is completely secure. Accordingly, while we work to protect personal data, we cannot guarantee absolute security.

Your privacy rights

Depending on your location and applicable law, you may have the right to request:

  • access to personal data we hold about you;
  • correction of inaccurate or incomplete personal data;
  • deletion of personal data;
  • restriction of processing;
  • objection to certain processing based on legitimate interests;
  • data portability;
  • withdrawal of consent where processing is based on consent; and
  • a review of certain decisions made solely by automated means, where applicable.

You may exercise your rights by contacting us at contact@mokn.io. We may need to verify your identity before completing a request. We will respond within the timeframe required by applicable law.

Individuals in the European Economic Area may also lodge a complaint with their local supervisory authority. In France, the supervisory authority is the Commission Nationale de l’Informatique et des Libertés (CNIL). Individuals in the United Kingdom may contact the Information Commissioner’s Office (ICO).

U.S. state privacy disclosures

Residents of certain U.S. states may have additional rights under applicable state privacy laws, which may include rights to know or access personal information, correct it, delete it, obtain a portable copy, and opt out of certain processing such as targeted advertising, sale of personal information or certain profiling.

MokN will honor applicable requests to the extent required by law. We will not discriminate against you for exercising applicable privacy rights. Where permitted by law, an authorized agent may submit a request on your behalf, subject to appropriate verification.

Cookies and similar technologies

The Services may use cookies or similar technologies for authentication, security, session management, preferences and technical operation. Where required by applicable law, non-essential cookies will be used only with the required consent and users will be provided with appropriate choices.

Children

The Services are intended for business and professional users and are not directed to children. MokN does not knowingly seek to collect personal data from children through the Services. If you believe that a child has provided personal data to MokN, please contact us so that we can take appropriate action.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our Services, practices or legal obligations. The updated version will be posted on our website with a revised effective date. Where required by law, we will provide additional notice of material changes.
